‘No evidence of money deposits to Revilla accounts’

Leigh Von Santos of the Anti-Money Laundering Council (AMLC) admitted before the Sandiganbayan yesterday that he has no documentary evidence or records to prove suspected pork barrel fund scam operator Janet Lim-Napoles or her business firm transferred or deposited money to bank accounts of Sen. Ramon “Bong” Revilla Jr.
Santos also admitted there are no bank records to show that co-accused Richard Cambe, Revilla’s former chief of staff, received cash from Napoles or from her JLN Corp.
Santos, who earlier accused Revilla of having some P87.628 million in unexplained wealth based on his bank transactions from April 2006 to April 2010 in an AMLC report, said an inquiry or investigation was conducted on Revilla’s bank accounts but the findings are not backed or supported by bank documents.
Under cross-examination, Santos maintained the probe revealed possible anomalies and violations of the Anti-Money Laundering Act.
Santos, a bank investigator, earlier said the deposits came close to the dates that principal witness Benhur Luy claimed Revilla, through Cambe, received commissions from his priority development assistance fund (PDAF) releases to the bogus non-government organizations of Napoles.
The AMLC report Santos submitted to the Sandiganbayan First Division even revealed how Revilla’s wife Cavite Rep. Lani Mercado’s Nature Concepts Development and Realty Corp. received substantial amounts through deposit totaling P27.745 million.
Santos yesterday said the company is a dummy corporation of Revilla who is on trial for allegedly pocketing P224 million in public funds.
Revilla, after the bail hearing, said the prosecution has failed to present proof that he received money from Napoles or her company.
“There really were no bank transfers from JLN Corp. There really were no bank transactions from JLN to my account,” he told reporters.
“I’m very confident that we will win in this case,” he said.
The hearing was cut short because the prosecution’s next and last witness for cross-examination, National Bureau of Investigation (NBI) forensic expert Joey Narciso, was not available because he was in hospital recuperating from dengue.
Revilla maintained his hard-earned money came from his acting roles in box office hits like the teleserye “Indio.”
“I have done over 100 movies and all those films earned profits. Not one of my films flopped in the box office. I earned the amounts they mentioned during the hearing legally,” he explained.
“Modesty aside, the amounts the prosecution accused me of stealing were loose change for me. I worked hard to provide for my family. I and my wife worked hard for what we have now,” Revilla said.
Revilla said the prosecution’s accusations changed over time since he was initially accused of getting P1.2 billion from Napoles, which amount later went down to P500 million, P400 million, P200 million, P87 million, and then P72 million.
He also denied his wife’s company is a dummy corporation, saying that Nature Concepts will be discussed and explained before the Sandiganbayan and the truth will slowly be exposed.
Defense lawyer Stephen David said the testimony of Santos did not do any damage since he was not able to prove any money trail and even admitted that all were based on Luy’s affidavits.
David said even the magistrates of the anti-graft court appeared dismayed by the testimony of the AMLC officer whose report was “mere conclusions” and speculations that money was given to Revilla.
Ombudsman prosecutors are expected to end their presentation of evidence for purposes of bail soon with defense counsels having the option to decide on whether or not they will also present witnesses.
On the other hand, the prosecutors are asking the Sandiganbayan to turn down the furlough request of .Sen. Jinggoy Estrada, another accused in the pork barrel fund scam.
Estrada is asking the Sandiganbayan’s Fifth Division to allow him to visit the graves of his grandparents and other relatives at the San Juan City Cemetery, including his Lola Mary and Lolo Emilio, on All Saints’ Day.
